Right of Withdrawal

This notice on the right of withdrawal applies to consumers who, under the mandatory law applicable to their contract, are entitled to a statutory right of withdrawal in connection with a distance contract.

The statutory right of withdrawal is independent of our voluntary 30-Day Money-Back Guarantee. The voluntary guarantee provides additional rights and does not restrict any statutory consumer rights.

1. Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason, provided that you are entitled to such a statutory right of withdrawal under the mandatory consumer protection law applicable to you.

The withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, receives the goods.

If you ordered several goods as part of a single order and they are delivered separately, the withdrawal period generally begins on the day on which you, or a third party designated by you, receives the last item.

If goods are delivered in several partial shipments or pieces, the withdrawal period generally begins upon receipt of the final partial shipment or final piece.

2. Exercising the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement.

We provide an online withdrawal function on btech-shop.com for this purpose. After successfully submitting your withdrawal, you will promptly receive an automatic confirmation that your withdrawal notice has been received.

To meet the withdrawal deadline, it is sufficient for you to send your statement concerning the exercise of your right of withdrawal before the withdrawal period expires.

Simply refusing to accept or collect a shipment does not automatically constitute a clear declaration of withdrawal. If you wish to withdraw from your contract, please therefore notify us expressly.

3. Effects of Withdrawal

If you validly withdraw from this contract, we will reimburse all payments received from you for the goods affected by the withdrawal, including the cost of our least expensive standard delivery option, where required under applicable law.

If you expressly selected a more expensive delivery method than our least expensive standard delivery option, we are not required to reimburse the additional shipping costs resulting from that choice.

Import VAT, customs duties, customs clearance or processing fees, and other import charges that were not charged or collected by b-tech cannot be reimbursed by b-tech. Any possible reimbursement of such amounts is subject to the rules of the competent authority or the relevant transport service provider.

The reimbursement will be made without undue delay and generally no later than 14 days from the day on which we are informed of your withdrawal.

In the case of sales contracts, however, we may withhold reimbursement in accordance with applicable law until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

We will generally use the same means of payment for the reimbursement that you used for the original transaction, unless expressly agreed otherwise. b-tech will not charge you any additional fees for the reimbursement.

4. Returning the Goods

After exercising your right of withdrawal, you must return the goods without undue delay and no later than 14 days from the day on which you informed us of your withdrawal.

The deadline is met if you send the goods before the 14-day period has expired.

You bear the direct cost of returning the goods, unless mandatory applicable law provides otherwise or we have expressly stated that we will bear these costs.

We recommend returning the goods in secure packaging and, where possible, using a tracked shipping method. This recommendation does not constitute an additional condition for exercising a statutory right of withdrawal.

5. Inspection of the Goods and Loss in Value

You may inspect and handle the goods to the extent necessary to determine their nature, characteristics, and functioning.

The statutory right of withdrawal does not automatically lapse merely because goods have been unpacked, handled, or used.

However, in accordance with applicable law, you may be liable for any loss in value of the goods if that loss in value results from handling that was not necessary to determine their nature, characteristics, and functioning.

Whether such a loss in value has occurred and the amount to be taken into account will be assessed based on the actual condition of the returned goods and the circumstances of the individual case. No flat-rate penalties or processing fees will be charged for this purpose.

The absence of or damage to the original packaging does not automatically result in the loss of the statutory right of withdrawal. However, where this has caused a compensable loss in value under applicable law, that loss may be taken into account accordingly.

6. Installation and Use

For products intended to be installed in a vehicle, installation or use may, depending on its nature and extent, go beyond the handling necessary merely to inspect the nature, characteristics, and functioning of the goods.

However, installation or use does not automatically result in the loss of the statutory right of withdrawal.

Where handling beyond what is necessary for inspection has caused an actual loss in value, compensation for that loss may be required in accordance with applicable law.

Independently of this, our voluntary 30-Day Money-Back Guarantee expressly permits proper installation and practical testing of products covered by the guarantee, subject to the separate guarantee terms.

7. Statutory Rights in the Event of Defects

The right of withdrawal is separate from statutory rights relating to defective or non-conforming goods.

If a product is defective or the wrong item has been delivered, the applicable statutory rights relating to defects and warranties remain unaffected by this notice on the right of withdrawal.

8. Relationship to the Voluntary 30-Day Money-Back Guarantee

This notice describes statutory rights of withdrawal only.

Our voluntary 30-Day Money-Back Guarantee is an additional service provided by b-tech and exists independently of those statutory rights.

In particular, the voluntary guarantee may permit more extensive installation and actual practical testing of the product, even where such use might be assessed differently when determining a possible loss in value under the statutory right of withdrawal.

The voluntary guarantee does not restrict any statutory rights of withdrawal, warranty rights, or other consumer rights.
